New information about the divorce between Halle Berry and Olivier Martinez has been released and we are learning things aren’t so black and white.

Earlier this week, the couple confirmed in a joint statement to PEOPLE that “we have come to the decision to divorce. We move forward with love and respect for one another and the shared focus of what is best for our son.” But now, it’s being questioned: Who filed first?

According to reports, Berry filed on Monday under the alias Hal Maria; this all for privacy reasons. However, Olivier filed just one day after Berry. According to TMZ, Martinez also used an alias, Oliver Martin. Their son Maceo was also listed as Mac Martin.

Per the news outlet, Berry also did not properly serve Martinez with the papers, rather just handed them to him. So now, it’s unclear who is divorcing who.

By the way, the couple does have a prenup and plan on splitting custody of their 2-year-old son.
