The truck driver involved in the crash that killed James McNair and injured several others, including comedian Tracy Morgan, was driving over the speed limit.
According to the National Transportation Safety Board, driver Kevin Roper was traveling at 65 mph in a 45 mph zone during the June 7 crash on the New Jersey Turnpike. NTSB says that particular stretch on the Turnpike is usually 55 mph, but was lowered to 45 mph due to construction.
Roper, who rammed into the limo bus carrying Morgan, pled not guilty last week to charges of death by auto. During the time of the fatal accident, Roper had reportedly been on duty for 13 hours 32 minutes, a half-hour shy of the federal limit.
Earlier this week, doctors treating Morgan for his injuries upgraded the comedian’s condition to fair. Tracy’s rep says the 45-year-old’s health is improving and his “personality is certainly starting to come back as well.”
