The truck driver responsible for the fatal crash on the New Jersey Turnpike over the weekend has pleaded not guilty.
Kevin Roper, whose WalMart truck slammed into Tracy Mogan’s chauffeured limo bus early Saturday morning, appeared in a New Brunswick courtroom to face charges of one count of death by auto and four counts of assault by auto. Roper, 35, pleaded not guilty to the crash which killed comedian, James McNair and injured Tracy Morgan and several others.
According to the criminal complaint, the 35-year-old operated the 18 wheeler “without having slept for a period in excess of 24 hours resulting in a motor vehicle accident.”
Morgan suffered several broken ribs, a broken nose and a broken femur. According to the comedian’s publicist, Morgan has shown signs of improvement but is expected to be hospitalized for several weeks.
McNair’s funeral is scheduled for Thursday.
